UDRP

Uniform Domain-Name Dispute-Resolution Policy — the ICANN-mandated process for resolving trademark disputes over generic TLD domains. Decided by arbitration, faster than court.

Three things the complainant must prove

  1. The domain is identical or confusingly similar to their trademark.
  2. The respondent has no legitimate interest in the name.
  3. The domain was registered AND used in bad faith.

Outcomes

Transfer to the complainant or denial. No money changes hands; no damages awarded. Decisions are binding on the registrar.
