UDRP
Uniform Domain-Name Dispute-Resolution Policy — the ICANN-mandated process for resolving trademark disputes over generic TLD domains. Decided by arbitration, faster than court.
Three things the complainant must prove
- The domain is identical or confusingly similar to their trademark.
- The respondent has no legitimate interest in the name.
- The domain was registered AND used in bad faith.
Outcomes
Transfer to the complainant or denial. No money changes hands; no damages awarded. Decisions are binding on the registrar.
